Kinship Proceedings
A kinship proceeding is the judicial process by which an alleged heir seeks to establish his/her relationship to the decedent.
Kinship issues most frequently arise in Surrogate's Court accounting proceedings that are brought by County Public Administrators for the purpose of having the Court determine the entitlement of an estate's assets.
The burden of proof is placed upon the "alleged heirs" to prove their kinship. Aunts, uncles, nieces, nephews and cousins must prove their relationship to the decedent. Even though these relatives have been in communication with the Public Administrator during the administration of the estate, a formal Court hearing that includes witness testimony and certified documentation will be required for the judicial ordering of the inheritance.
